A Queens Family Court judge ordered the arrest of a 15-year-old girl Monday after she admitted making up stories that her mom abused her.
What made the girl's arrest even more shocking, witnesses said, is that everyone in the courtroom - including the judge - had known for a year that Ingrid Navez lied about the abuse.
"The child is being punished for coming forward," said family therapist Haydee Zambrana, , who was translating the proceedings for the family.
Ingrid was 13 in 2007 when she told police her mom beat her. She said she lied because she was angry at her protective mom for forbidding her to have a boyfriend.
The lie forced her mom, Claudia Navez,, to move out of the house and get family therapy. A chastened Ingrid admitted inventing the tale in letter to the court last year, said those familiar with the case.
But workers for the Administration for Children's Services said Ingrid's little brother said he, too, was struck - and they pursued the case.
After Ingrid said on the stand that she lied Monday, Judge Marybeth Richroath ordered officers to march her straight to the 103rd Precinct stationhouse, said those at the hearing.
"My daughter lied, but she's innocent. She didn't know what she was doing. She was 13," Claudia Navez said in Spanish.
"Now she is suffering for one mistake in her childhood. She didn't understand the consequences."
The teen was expected to be charged with filing a false police report, a misdemeanor, and released on a desk appearance ticket last night.
Richroath said she had no choice but to turn the girl over to cops because "she felt she was witness to a crime in the courtroom," courts spokesman David Bookstaver said.
The judge also said she tried to keep the girl off the stand for her own protection by getting both sides to legally agree that her story had changed, Bookstaver said. Instead, Ingrid's mother insisted the girl testify, he said.
Claudia Navez said she was never told her daughter could get arrested if she took the stand. Navez and Ingrid blamed their lawyer Robin Einbinder for grilling her on the stand about lying to cops, never having warned them Ingrid was in danger of being arrested.
"It looked like [Einbinder] did want me to go to jail," Ingrid said. Einbinder did not return calls.

Let me ask the public another question...
Should adults that have lied to child servives..courts.. and judges.. BE JAILED?
If not then why?
Especially where it can be PROVEN by child services own documents!
